Yes, you can install a charger in your community garage space without the community voting on it. Article 17.5 of Spain's Horizontal Property Act only requires you to notify the community in advance. The costs of the installation and the electricity consumed are paid by you. An installation in a community space costs, as a guide, between €900 and €1,800, and if you finish it before 31 December 2026 you can deduct 15% on your IRPF tax return.

Living in a block of flats is no longer an obstacle to owning an electric car. The law protects your right to install a charging point in your parking space, and the procedure is simpler than it seems.

In this guide we explain what the law says, how much it costs, what steps to follow and what support is available.

What the law says: your right to install the charger #

Article 17.5 of the Horizontal Property Act establishes that, to install a privately-used charging point in an individual parking space, it's enough to notify the community in advance. No vote at a meeting or authorisation is required.

The owner who installs it bears the cost of the installation and of the electricity consumed.

The Supreme Court confirms it #

Spain's Supreme Court (First Chamber) has ruled that installing a charging point in an individual space in a community garage only requires giving the homeowners' association prior notice. You can read the press release from the Judiciary (in Spanish).

What the community can and can't do #

The community cannotThe community can
Require the installation to be put to a voteReceive your prior notice in writing
Block it purely on disagreementRequire the work to be carried out properly and respect shared areas
Charge you for allowing itAsk that technical regulations be met

Your right is to install the charger. The community's right is for the work to be done properly and not damage what belongs to everyone.

Legal commentary notes that the community could object in an extreme case, if it can show disproportionate harm to shared elements. If you find yourself in that situation, consult a lawyer.

How much it costs to install a charger in a community garage #

As a guide, an installation in a community space costs between €900 and €1,800. The exact price depends on the distance to the connection point, how your consumption is metered, and whether conduit work is needed through shared areas.

ItemIndicative price
Full installation in a community garage space€900 – €1,800

You'll find the full breakdown and typical cases in our guide on the price of installing a charger in a community garage. If you charge at a home with your own garage, see the price in Granada.

Who pays for the installation and the consumption #

  • The installation: the owner who requests it.
  • The electricity consumption: also the owner. Your consumption needs to be measurable separately, via your own meter, a connection from your home, or shared infrastructure.
  • The community: pays nothing, unless the general meeting voluntarily decides to build shared infrastructure.

The procedure, step by step #

  1. Site visit. An installer checks the space, the fuse box and the best way to connect.
  2. Quote and project. You receive a written quote and, if applicable, the technical documentation.
  3. Notice to the community. Notify the president or the managing agent in writing. Include your details, the parking space, your intention to install the charger, the planned date, and that it will be carried out by an authorised installer. Keep a copy and proof of receipt. There's no need to wait for a response.
  4. Installation by an authorised installer, complying with ITC-BT-52.
  5. Documentation and certification. The installation certificate and, where applicable, its registration with the relevant authority.
  6. Registering the supply or the meter with the distribution or supply company, if needed.
  7. Keep the invoice and proof of payment, in case you apply the IRPF deduction.

Safety and technical regulations #

ITC-BT-52 of the Low Voltage Electrotechnical Regulation governs charging installations: cable routing, protections and consumption metering. That's why it's compulsory to use an authorised electrical installer. If you're concerned about the garage's safety, ask how the circuit protection has been designed and how it complies with the regulations.

Several neighbours in the same garage #

Each owner can install their own. When there are several interested parties, it's worth considering dynamic load management, which shares out the available power, or shared pre-installation that allows points to be added over time. This avoids having to increase the garage's contracted power every time someone joins in. The sooner you raise it with the community, the easier it will be to agree on a shared solution.

Grants and tax relief #

  • Plan MOVES III: closed on 31 December 2025.
  • IRPF deduction: 15% on amounts paid, with a maximum base of €4,000 (up to €600), if the installation is finished before 31 December 2026 and the space belongs to you. It's applied in the 2026 tax return.

All the requirements and a timeline for getting it done in time are in our guide to the 15% IRPF deduction for your charger. And on grants and subsidies you'll find the other options.

If you want to combine it with storage #

If you also have solar panels, a charger with a battery can help you make better use of your surplus. See our battery storage page.
